Cookie FAQ
What is a cookie?
Cookies are "mini files" that can be placed on the device of a user connected to the Internet, such as a computer, phone, tablet or smart TV. Cookies can be used to collect or store information about how the user behaves on (a website on) the Internet and/or on their device. "Reading" these cookies then allows the websites that placed them to retrieve the information stored in them.
Obtaining the user’s consent
If you wish to place and/or read cookies on, or from, a user’s device, you must explain clearly and simply what these cookies do and why you use them. In principle, you must also obtain the user’s consent to place and read these cookies. Consent must be given by a clear affirmative act. There are, however, two situations in which you do not need the user’s consent:
- When the cookies are strictly necessary to provide a service expressly requested by the user (for example, cookies that keep a user’s shopping basket, or cookies that secure a banking application).
- When the cookies are strictly necessary to transmit a communication over an electronic communications network (such as cookies used for load balancing).
Record of processing activities
Using cookies is a processing of personal data. This processing must be added to your record of processing activities.
Tracking pixels
The obligation to obtain consent goes well beyond the cookies used on your website. Pay particular attention to tracking pixels, for example in the newsletters you send to your subscribers. These also require prior consent.
